In the state of Maryland, you can be convicted of three different charges when driving after consuming alcohol. The difference between them is largely a matter of degree.


Two Types of DWI Charges


You can be charged with either driving under the influence (DUI) or driving while impaired (DWI).


When you are pulled over, the police officer will ask you to perform a series of field sobriety tests. You will also be asked to take a breath test to determine your BAC. If you refuse, your license will automatically be suspended for 120 days and your refusal can be used as an admission of guilt in court.
The difference between a DUI and DWI is one of degree. A DUI means your physical coordination was substantially impaired. A DWI means your physical coordination was simply impaired by alcohol. A DUI per se means your BAC was .08 or greater, no matter how little the alcohol affects your physical coordination.


Consequences


The penalties for a DUI conviction are:

  • Suspension or revocation of your driver's license
  • Maximum $1,000 fine
  • Up to one year in jail
  • 12 points on your license

 

For a DWI, the consequences are:

  • Suspension or revocation of your driver's license
  • Maximum $500 fine
  • Up to two months in jail
  • 8 points on your license

 

Keeping your License


The state of Maryland gives you an opportunity to appeal the suspension of your driver's license when you receive a DUI. However, the appeals process is time sensitive.


You have 30 days to request a hearing with the Motor Vehicle Administration (MVA). If you fail to send in your hearing request form on time, your license will automatically be suspended. It is crucial to have an experienced DUI attorney at your appeals hearing.
