It is important to remember that the divorce and child custody laws are not the same as in other states or like what you may see on television. In divorce matters, Maryland is not a community property state; Maryland is an equitable distribution state. This means the courts will try to do what is equitable, or fair. This also means that you need advise from a Maryland domestic lawyer to dispel many of the myths that your friends, family members, or neighbors may mistakenly tell you, and that you may mistakenly believe.

ESTATE PLANNING AND WILL PREPARATION
Estate planning involves more than just making a will to dispose of your possessions and bank accounts. Proper estate planning can prevent difficult situations and impossible dilemmas. For example, if you became incapacitated tomorrow, is there someone with the power to make financial and medical decisions for you? If not, your loved ones may have to resort to a lengthy and costly court proceeding to have a guardian court appointed to make those decisions for you. Since a guardian is appointed by the court, the guardian may not be someone you would have chosen if you had the option to choose for yourself. Our attorneys can help you make these sensitive decisions now.

If you pass away without a will, you are allowing the State of Maryland to direct how your assets will be distributed. However, with a will you can select the people you want to receive property or money from your estate, as well as the person you want to administer your estate. For people with young children, a will is crucial so that they can select a legal guardian and establish a trust for the child, along with picking the rules for how and when that money will be given to the children. Even people without children who only own property with their spouse need a will so that upon the death of both spouses, the property can be distributed according to their wishes.
