ESTATE PLANNING AND WILL PREPARATION If you pass away without a will, you are allowing the State of Maryland to direct how your assets will be distributed. However, with a will you can select the people you want to receive property or money from your estate, as well as the person you want to administer your estate. For people with young children, a will is crucial so that they can select a legal guardian and establish a trust for the child, along with picking the rules for how and when that money will be given to the children. Even people without children who only own property with their spouse need a will so that upon the death of both spouses, the property can be distributed according to their wishes.
