After Your Maryland DUI/DWI Arrest: 10 Steps in 10 Days (Part A)

If you've been arrested for DUI or DWI in Maryland, you only have a short time to fight for your driving privileges. While you have the option to represent yourself, the likelihood your rights are fully defended will be higher if you're represented by an Annapolis DWI defense lawyer. Maryland DUI/DWI laws are complicated and the information from the Motor Vehicle Administration isn't always all-inclusive.

10 Steps in 10 Days to Retain Your Driving Rights

If you begin the process by following these 10 steps you will be on the right track to defend your rights. These are not all-encompassing, however, and nothing can replace the services of a good criminal defense attorney in Maryland:

  • Request a Motor Vehicle Administration (MVA) hearing within 10 days of your arrest. If you want a hearing before your license is automatically suspended, you must make a request within the 10-day time limit.
  • Your request must include the $125.00 filing fee. If you fail to include the fee, your request will be automatically denied. Do not send cash, and it's best to send the request and fee via registered or certified mail.
  • The Officer's Certificate and Order of Suspension will serve as your temporary license until your hearing. This is a white paper with red lettering, and it should say DR-15A in the top right corner. Treat this as your license and do not lose it.
  • Don't assume that because you didn't receive the DR-15A form that the MVA will not suspend or revoke your license. It's possible the police officer just failed to give you the correct documentation, but that doesn't prevent the MVA from taking away your driving rights.
  • If your license is from another state, that state may take action against your license. Even if the arresting officer did not confiscate your license, you should still prepare to file a request for a hearing in your home state.
