After Your Maryland DUI/DWI Arrest: 10 Steps in 10 Days (Part B)

If you are arrested or charged with a DUI or DWI in Maryland, you could be facing serious consequences. Additional steps to retain your driving rights include:

  • Your temporary license (DR-15A, the Officer's Certification and Order of Suspension) is only valid for 45 days. Whatever the officer or MVA lead you to believe, your temporary license is not valid until your court date, but only for 45 days.
  • Remember that your MVA hearing and your court date are completely separate from one another. Do not assume that by going to one, you don't have to go to the other. Under Maryland DUI/DWI laws, these are independent of one another.
  • If you took a BAC test, the MVA must prove 3 things - that the officer had reasonable cause to believe you were under the influence, that you refused or submitted to a test and got a .08 or higher, and that you were aware of the sanctions.
  • The burden is on the MVA to prove all 3 conditions. This is important. To meet the requirements of the law, the MVA must meet the burden of proof - not you.
  • If just one issue is disproven by your Annapolis DWI defense lawyer, your license will not be suspended or revoked. Two out of three is not enough to take away your license.
