Maryland DUI Defense: What You Should Know When You've Been Stopped (Part B)

It's important that you schedule a meeting with a Glen Burnie DUI lawyer immediately after you have been suspected of driving under the influence. One of your legal rights is the right to have an attorney, and now more than ever, you may need one for your Maryland DUI defense.

When You are Asked to Step Outside Your Vehicle

When you see blue lights flashing in your rear-view mirror, your mind might start racing, and you may begin to wonder how you'll get to and from work, or the baby sitter's and even doctor's appointments if you lose your license. As we stated previously, this is not the time to panic.

Another one of your legal rights is the right to refuse to be tested. You can politely tell the police officer that you will not submit to any of the following:

  • field sobriety test (horizontal gaze nystagmus, stand on one leg, walk and turn);
  • Intoximeter or Breathalyzer test (blow into a device that measures the alcohol in your bloodstream); and
  • preliminary breath test (blow into a device that's smaller than a Breathalyzer to measure your blood alcohol content).

These tests along with the techniques officers use to gather DUI evidence have come under scrutiny. When successfully challenged in court, the tests have been labeled imperfect and imperfectly administered.

Be Polite and Respectful to the Police Officer

Although you can refuse the above-mentioned tests, you should still be cautious when pulled over. By all means, be respectful and polite to the police officer, using the words sir or ma'am, especially when informing him or her that you know your legal rights.

If you naturally are not very articulate, you may want to avoid engaging in conversation. Any stammering on your part could erroneously be considered signs of intoxication.

Your actions when pulled over will play a major role in your Maryland DUI defense, and by acting appropriately, you can help your Glen Burnie DUI lawyer prepare a strong Maryland DUI defense.
