The Truth about Driver’s License Reinstatement after DUI in Maryland (Part A)

Getting your license reinstated after losing it from a DUI in Maryland can be a frustrating process, but those frustrations and anxieties can be mitigated the sooner you involve an Annapolis, Maryland drunk driving defense attorney dedicated to protecting your legal rights and privileges.

When Your Driver’s License is Revoked after a DUI in Maryland

When you are pulled over for a potential DUI, you may be asked to provide a preliminary breath test or perform a number of field sobriety tests to demonstrate your level of intoxication, the results of which will be recorded by the police officer who stopped you. If it is determined that you are driving drunk, your license will be confiscated immediately by the police.

You will be given a DR15 form that will act as a temporary license for 45 days before your suspension goes into effect. If you were driving alone, you will most likely be arrested and taken away in handcuffs. In some instances, if there is a sober passenger in your car, he or she will be able to drive you home in lieu of you being put in jail and your car impounded.

In that time, you can and should request a hearing with the Motor Vehicle Administration, in which you and your attorney will have the chance to challenge the grounds upon which you were stopped. A police officer must have reasonable suspicion to stop you for drunk driving, and if it’s shown that reasonable suspicion was absent, your charges may be thrown out entirely.
