For a First Offense Maryland DWI in Annapolis a DUI Lawyer Can Help (Part A)

You've just been cited for your first offense Maryland DUI and you don't know what to do. This is a situation many drivers may find themselves in while driving in Annapolis. A DUI lawyer should be their next thing to consider after an arrest. Whether you've been pulled over for a Maryland DWI or DUI, to protect your rights, you'll want to speak with a lawyer as soon as possible.

As in most states, the Maryland DUI laws prohibit driving with a Blood Alcohol Content (BAC) of .08% or above. If during a traffic stop you're found to have a BAC of at least .07% but less than .08% it's considered a Maryland DWI, which is a lesser but still serious offense.

During the traffic stop the officer will ask you to submit to a sobriety test. It may be a portable breathalyzer test, or a physical assessment. You have the right to refuse these tests, but doing so will often result in increased penalties upon conviction.

Penalties for Maryland DWI and DUI First Offenses

Your license will be confiscated by the arresting officer once it's determined you're under the influence of drugs or alcohol. License suspension can often be for up to 60 days for a first offense Maryland DUI. This duration can increase to 120 days if you decline to take the blood or breath test.

Jail time can be up to 12 months for a first offense DUI and up to 2 months for a DWI and you may face up to $500 in fines for a DWI and $1,000 for a DUI. Several
points can also be assessed to your driving record. In either case, you'll be required to also attend a state-approved alcohol education program if you seek to obtain a restricted license or qualify for reinstatement after the end of your license suspension.
