Arrested for DWI/DUI in Maryland? That Doesn’t Mean Automatic Guilt! (Part A)

When most drivers are arrested for DWI/DUI in Maryland they think it's an automatic conviction. Without consulting with a DUI attorney in Glen Burnie, Maryland, it very well could be - even if you're not guilty! Remember that upon arrest you have the right to an attorney.

DUI Charges Begin: The Traffic Stop

There are many reasons an officer may pull you over while driving, but they must have probable cause for doing so. Some of the common driving behaviors that lead to DUI arrests include:

  • weaving over the lines;
  • erratic stopping and accelerating;
  • speeding;
  • driving with an expired or missing tag;
  • equipment failure (tail lights, mirrors, etc.); and
  • other signs of distress or reckless driving.

Any driving behaviors out of normal operation or problems with your vehicle can cause an officer to stop you for further examination.

Determining Intoxication at a Traffic Stop

To charge you with DWI/DUI in Maryland the officer must have evidence that you were driving while intoxicated. The initial arrest is typically made after the officer puts you through a test at the scene to determine your level of intoxication. The 2 most common tests are the portable breathalyzer and the field sobriety tests, but neither can be considered completely accurate.

You have the right to refuse a breathalyzer test, but this can result in up to 120 days suspension of your license for a first offense, and up to a year for subsequent offenses.

The accuracy of field sobriety tests is also a common point of defense against DUI charges. Many of these tests evaluate physical dexterity, which isn't always easy to achieve in some conditions of testing. Drivers may have other medical conditions that impair them from performing these tests, or pavement conditions may produce false responses.

Failing either type of intoxication evaluation is not an automatic indication of guilt.
